1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PageMatch ("Company," "we," "us," or "our"), operated at pagematchapp.com. By accessing or using the PageMatch platform, including any associated services, features, content, or applications (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
PageMatch is a software-as-a-service (SaaS) platform that provides AI-powered analysis of Google Ads landing pages. The Service enables users to upload ad creatives, submit landing page URLs, and receive automated analysis scores, recommendations, and reports designed to improve advertising performance and conversion rates.
The Service uses artificial intelligence to generate analysis results. While we strive for accuracy, AI-generated insights are provided as recommendations and should not be treated as guaranteed outcomes. You are solely responsible for any changes you make to your advertising campaigns or landing pages based on PageMatch analysis.
3. Account Registration
To use certain features of the Service, you must create an account by authenticating through Google OAuth. You agree to provide accurate information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent that you meet this age requirement.
You must notify us immediately if you suspect any unauthorized access to or use of your account. We are not liable for any loss arising from unauthorized use of your account.
4. Subscription Plans and Billing
PageMatch offers the following subscription tiers:
- Free: 3 analyses per month at no charge, with limited feature access.
- Pro ($29/month): 20 analyses per month with full audit capabilities, AI content rewrites, competitor comparison, weekly monitoring, and PDF reports.
- Agency ($79/month): 100 analyses per month with all Pro features plus batch upload, white-label reports, expanded monitoring, and priority support.
Paid subscriptions are billed monthly in advance through Stripe, our third-party payment processor. By subscribing to a paid plan, you authorize us to charge the applicable fees to your designated payment method on a recurring monthly basis until you cancel.
All fees are stated in U.S. dollars and are exclusive of any applicable taxes, which you are responsible for paying. We reserve the right to modify pricing with at least 30 days' written notice. Price changes will take effect at the start of your next billing cycle following the notice period.
5. Free Trial and Cancellation
We may offer free trial periods for paid plans at our discretion. At the end of a trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial expires.
You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods, except as required by applicable law.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service to analyze, promote, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Upload ad creatives or submit URLs containing malware, phishing content, or any material designed to harm or deceive.
- Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
- Use automated scripts, bots, or scrapers to access the Service in a manner that exceeds reasonable usage or circumvents rate limits.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service.
- Resell, sublicense, or redistribute the Service or any output generated by the Service without our prior written consent, except as expressly permitted under your subscription plan (e.g., white-label reports under the Agency plan).
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
We reserve the right to suspend or terminate your account if we reasonably determine that you have violated these acceptable use provisions.
7. User Content
"User Content" refers to any ad creatives, images, landing page URLs, and other materials you upload or submit to the Service. You retain all ownership rights in your User Content.
By submitting User Content, you grant PageMatch a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or your account, except for copies retained in backups or as required by law.
You represent and warrant that you own or have the necessary rights and permissions to submit all User Content, and that your User Content does not infringe or violate any third party's intellectual property rights, privacy rights, or other legal rights.
8. Intellectual Property
The Service, including its design, software, algorithms, text, graphics, logos, and all other content provided by PageMatch (excluding User Content), is the exclusive property of PageMatch and is protected by copyright, trademark, and other intellectual property laws.
Analysis results, scores, and recommendations generated by the Service based on your User Content are licensed to you for your internal business use. You may share generated reports with your clients or team members as permitted by your subscription plan.
Nothing in these Terms grants you any right, title, or interest in the Service or its underlying technology beyond the limited license to use the Service as described herein.
9. Third-Party Services
The Service integrates with and relies upon third-party service providers, including but not limited to Stripe (payment processing), Anthropic (AI analysis), Browserless (page screenshots), Supabase (data storage), Resend (transactional email), and Vercel (hosting). Your use of the Service is also subject to the terms and policies of these third-party providers where applicable.
We are not responsible for the availability, accuracy, or practices of any third-party services. We do not endorse and are not liable for any harm arising from your interaction with third-party services accessed through or in connection with the Service.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, PageMatch disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that any analysis or recommendation provided by the Service will achieve specific results in your advertising performance.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall PageMatch, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service, regardless of the theory of liability.
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you have paid to PageMatch in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless PageMatch and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the Service at any time and for any reason, including but not limited to a breach of these Terms, with or without notice. You may terminate your account at any time by contacting us or through your account settings.
Upon termination, your right to use the Service ceases immediately. We may delete your account data, including User Content, within a reasonable period following termination unless retention is required by law. Sections of these Terms that by their nature should survive termination (including, without limitation, intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date, and where practicable, by sending you an email notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
16. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PageMatch concerning the Service.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
